Council has exhibited a planning proposal affecting:

  • Lot 9 DP 1149340, 9 Industry Road, Vineyard,
  • Lot 13 DP 815849 and Lot 6 DP 777933, 312 Windsor Road, Vineyard, and
  • Lot 6028 DP 1169449, 7 Fernadell Drive, Pitt Town.

The objective of the planning proposal was to;

(a) Reclassify Lot 9 DP 1149340, 9 Industry Road, and Lot 13 DP 815849 and Lot 6 DP 777933, 312 Windsor Road, Vineyard from ‘Community’ land to ‘Operational’ land;

(b) Reclassify part of Lot 6028 DP 1169449, 7 Fernadell Drive, Pitt Town from ‘Community’ land to ‘Operational’ land;

(c) Rezone part of Lot 6028

Council has exhibited a planning proposal affecting:

  • Lot 9 DP 1149340, 9 Industry Road, Vineyard,
  • Lot 13 DP 815849 and Lot 6 DP 777933, 312 Windsor Road, Vineyard, and
  • Lot 6028 DP 1169449, 7 Fernadell Drive, Pitt Town.

The objective of the planning proposal was to;

(a) Reclassify Lot 9 DP 1149340, 9 Industry Road, and Lot 13 DP 815849 and Lot 6 DP 777933, 312 Windsor Road, Vineyard from ‘Community’ land to ‘Operational’ land;

(b) Reclassify part of Lot 6028 DP 1169449, 7 Fernadell Drive, Pitt Town from ‘Community’ land to ‘Operational’ land;

(c) Rezone part of Lot 6028 DP 1169449, 7 Fernadell Drive, Pitt Town from RU2 Rural Landscape to RE1 Public Recreation to enable the development of the subject site for community and recreational purposes;

(d) Amend the minimum lot size for subdivision of Lot 6028 DP 1169449, 7 Fernadell Drive, Pitt Town to part 4,000m2 and part no minimum lot size; and

(e) Amend the maximum height of buildings on part of Lot 6028 DP 1169449, 7 Fernadell Drive, Pitt Town.

The planning proposal aims to achieve this intended outcome by:

Amending Hawkesbury Local Environmental Plan 2012, Schedule 4, Part 1 – Land classified, or reclassified, as operational land – no interests changed to include 9 Industry Road and 312 Windsor Road, Vineyard;

Amending Hawkesbury Local Environmental Plan 2012, Schedule 4, Part 2 – Land classified, or reclassified, as operational land – interests changed to include part of 7 Fernadell Drive, Pitt Town;

Creating a Land Reclassification (Part Lots) Map for the Hawkesbury Local Environmental Plan 2012 to identify part of 7 Fernadell Drive, Pitt Town as being ‘Operational Land’;

Amending the Land Zoning Map of Hawkesbury Local Environmental Plan 2012 to rezone part 7 Fernadell Drive, Pitt Town to RE1 Public Recreation;

Amending the Lot Size Map of Hawkesbury Local Environmental Plan 2012 to permit a minimum lot size of 4,000m2 for part of 7 Fernadell Drive, Pitt Town and removing the current 10ha minimum lot size provision applying to the remainder of 7 Fernadell Drive, Pitt Town;

Amending the Height of Buildings Map of Hawkesbury Local Environmental Plan 2012 to remove the current 10m maximum building height provision applying to part of 7 Fernadell Drive, Pitt Town.

The planning proposal and other supporting documentation is on public exhibition for the period Thursday 27 May 2021 to Friday 25 June 2021.

The planning proposal and other supporting documentation can be viewed during the exhibition period on Council’s online community engagement site HERE, or between 9:00am to 4:00pm Monday to Friday at Council’s Administration Office, 366 George Street, Windsor.

Written submissions in relation to the planning proposal should be referenced “LEP001/19” and can be posted to Hawkesbury City Council, PO Box 146, WINDSOR NSW 2756 or emailed to council@hawkesbury.nsw.gov.au.

The last day for the receipt of submissions is Friday 25 June 2021.

Please note confidentiality is not available to respondents. The details of any submissions may be included in a Council report or forwarded to the proponent where it may help to resolve issues raised in the submission. Information (including copies of submissions) may also be released in accordance with Council’s Access to Information Policy.

The inclusion of personal information with your submission is voluntary. However, if not provided Council will not be able to contact you about the proposal. The information will be stored in Council's electronic records system and paper files. For your protection, Council recommends that you do not include defamatory comments in your submission.

Under Section 10.4(5) of the Environmental Planning and Assessment Act 1979, any person who makes a submission to Council is required to disclose any political donation or gift. Where relevant a Political Donation and Gift Disclosure Statement is to accompany any submission lodged with Council. This statement can be obtained from Council’s Customer Service Unit or on Council’s website.

Any comments about this proposal may contain information that is personal information, such as information that identifies you, etc, for the purposes of the Privacy and Personal Information Protection Act 1988.

Submissions are balanced with Council’s statutory obligations, the rights of the proponent and the public interest. Council must consider any submissions made before it decides whether to proceed with or abandon a proposal.

A public hearing is required for any Planning Proposal that reclassifies public land from community to operational land.

The Public Hearing is scheduled to be held on Thursday 5 August 2021 at 6pm.

The hearing will be chaired by an independent person from Parkland Planners.

Due to the current NSW public health order with respect to COVID-19, the hearing will be held online using the Zoom platform.

Interested persons will need to register with Council by close of business on Friday 30 July 2021 to:

  • Virtually attend or listen to the hearing
  • Make a submission at the hearing

    A Public Hearing was held on 5 August 2021 to provide opportunity for the community’s views to be heard about a proposal to reclassify land at 9 Industry Road, Vineyard, 312 Windsor Road, Vineyard, and part of 7 Fernadell Drive, Pitt Town from ‘Community’ land to ‘Operational’ land.

    The hearing was independently chaired by Sandy Hoy from Parkland Planners.

    Council has received the ‘Proposed Reclassification of Community Land at Vineyard and Pitt Town’ Public Hearing Final Report from Parkland Planners which considers the outcome of the Public Hearing.

    The Report concludes that the reclassification of the subject sites from ‘community’ land to ‘operational’ land should proceed.

    Council will consider the Report from Parkland Planners at an upcoming Council Meeting.
