As a land owner or occupier in the vicinity of the subject site you have been notified in writing and you may wish to make a written submission to Council. If you choose to make a submission it will be taken into account by Council officers in assessing the proposal. The last day for the receipt of submissions is Monday 13 February 2017.

A planning proposal is a document that explains the intended outcome of a proposed amendment to a local environmental plan and sets out the justification for making that amendment. 

The preparation of a planning proposal is only the first step in preparing an amendment to Hawkesbury Local Environmental Plan 2012 (the LEP).

A planning proposal usually seeks to change the current zoning of the land or the LEP provisions to allow a type of development that is currently prohibited. Council needs to carefully consider the suitability of the proposed change including submissions from the public and relevant agencies. After a planning proposal is supported and if the amendment is made, other steps occur such as lodgement of a development application.

The objective of the planning proposal is to amend Hawkesbury Local Environmental Plan 2012 (the LEP) to enable subdivision of the subject site into 10 large residential lots and one road lot that provides access to the proposed residential lots with two different minimum lot sizes of not less than 4,000m² and 1ha.

The planning proposal will provide increased housing opportunities within a reasonable walking distance to Kurrajong Neighbourhood Centre.

You can access these documents from the 'Document Library' located at the right hand bottom corner of this webpage. Alternatively, you can view them between 8:30am to 5:00pm Monday to Friday at Council’s Administration Office, 366 George Street, Windsor or on Council’s website at http://www.hawkesbury.nsw.gov.au/development/development-information/local-environment-plans/draft-local-environmental-plans during the exhibition period.

Where relevant a Political Donation and Gift Disclosure Statement, enclosed, must accompany any submission lodged with Council. Under Section 147(5) of the Environmental Planning and Assessment Act 1979 any person who makes a submission to Council is required to disclose any political donation or gift.

The inclusion of personal information with your submission is voluntary. However, if not provided Council will not be able to contact you about the proposal. The information will be stored in Council's electronic records system and paper files. For your protection, Council recommends that you do not include defamatory comments in your submission.

Any comments about this proposal may contain information that is personal information, such as information that identifies you, etc, for the purposes of the Privacy and Personal Information Protection Act 1988.

Council may not accept late submissions except in exceptional circumstances.

Yes. Confidentiality is not available to respondents. The details of any submissions may be included in a Council report or forwarded to the proponent where it may help to resolve issues raised in the submission. Information (including copies of submissions) may also be released in accordance with Council’s Access to Information Policy.

Yes. Council will invite all submission authors to attend the meeting and allow an opportunity to make a short claim in support or objecting to the proposal when Council takes the proposal into consideration. Submissions are balanced with Council’s statutory obligations, the rights of the proponent and the public interest. Council must consider any submissions made before it decides whether to proceed with or abandon the proposal.

The (then) Minister for Planning and Envionment delegated his plan making powers to Council in October 2012, and Council accepted this delegation. As part of the Gateway determination”, Council received a ‘Written Authorisation to Exercise Delegation’ (the Authorisation) for the amendment of the LEP. Therefore, if the planning proposal proceeds, Council will make the amendment to the LEP to give effect to the planning proposal.

Under sections 59(2) and (3) of the Environmental Planning and Assessment Act, 1979 Council can decide not to make the amendment to the LEP. If Council resolves to not make the LEP amendment, Council's assessment report needs to clearly identify the reasons behind this decision including whether the decision to not proceed was based on public submissions received during the public exhibition, a public agency submission, or some other matter that was arose during the LEP amendment process.
